1. Acceptance of Terms
By downloading, installing, or using the StayFit mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and StayFit (“we,” “us,” or “our”).
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or on our website at getstayfitapp.com. Your continued use of the App following any changes constitutes acceptance of those changes.
2. Account Creation and Responsibilities
To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old to create an account and use the App.
You agree to notify us immediately at support@getstayfitapp.com of any unauthorized use of your account or any other breach of security.
3. Subscription Terms
StayFit offers a free tier with basic features and a premium subscription (“StayFit Pro”) that provides access to advanced features including AI-powered workout plans, food photo macro estimation, and personalized recovery insights.
Free Trial: New subscribers may be eligible for a free trial period of 3 days. During the free trial, you will have full access to all premium features. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation:You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. All payments are processed by Apple and are subject to Apple's terms and conditions.
Price Changes: We may change subscription prices from time to time. Any price changes will take effect at the start of your next billing period following notice of the change.
4. User-Generated Content
The App allows you to create, upload, and store content including workout logs, progress photos, notes, and other data (“User Content”). You retain ownership of all User Content you create.
By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving the App's services to you. We will not share, sell, or use your User Content for advertising or marketing purposes.
You are solely responsible for your User Content. You agree not to upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
5. AI Features Disclaimer
StayFit Pro includes AI-powered features such as workout plan generation, food photo macro estimation, and recovery suggestions. These features are provided for informational and convenience purposes only.
AI-generated content is not a substitute for professional medical, nutritional, or fitness advice. Macro estimates from food photos are approximate and should be reviewed and edited before saving. Workout suggestions are based on general fitness principles and your usage patterns, but may not be suitable for your specific health conditions.
Always consult with a qualified healthcare provider or certified fitness professional before beginning any new exercise program or making significant changes to your diet. You use AI features at your own risk.
6. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the App, you agree to the collection and use of information in accordance with our Privacy Policy.
7. Termination and Account Deletion
You may delete your account at any time through the App's Settings menu (Settings → Manage Account → Delete Account). Upon account deletion, all your personal data, workout history, photos, and other User Content will be permanently removed from our servers within 30 days.
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to other users or the App.
8. Disclaimers and Limitation of Liability
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE APP AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STAYFIT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
